How Long Do You Have to File a Personal Injury Claim?

New York law limits the time you have to file a personal injury lawsuit. In most cases, the statute of limitations is three years from the date of the injury. However, certain cases have shorter deadlines:

  • Medical Malpractice: Must be filed within 2 years and 6 months from the malpractice date.
  • Claims Against a Government Entity: A Notice of Claim must be filed within 90 days, and a lawsuit within 1 year and 90 days.
  • Cases Involving Minors: The filing deadline may be extended until the victim turns 18.
